Concerning a fundamental social right, the so-called housing problem is far from being solved and within the recent economic recession and real estate crisis in Spain, vacant wellings and the (no) right to a dwelling still represent a very important question. In this article the author firstly analyses the dimension of the vacant and underutilised dwellings in Europe, Spain and the Basque Autonomous Community, as well as the recent housing policies in the Basque Autonomous Community. Secondly, the Basque housing law proposal is presented, which improves the compliance of this constitutional right in the territory. In fact, together with other housing law proposals (for example in Catalonia and Andalusia), the Basque initiative represents a very interesting attempt to develop the traditional housing policies in the aforementioned way.
